Extraordinary lease extension 2026: can you ask for it?

Piso Propio ·

If your lease was in force on 8 October 2026 and ends before 31 December 2028, Royal Decree-law 29/2026 lets you ask for an extraordinary extension in yearly periods, up to two years, on the same terms, as long as you are up to date with the rent. The landlord must accept it except in three cases. Answer four questions and we tell you, with the letter to send.

Checked on 11 October 2026 against the BOE and congreso.es.

Status of the decree

Royal Decree-law 29/2026 has applied since 8 October 2026 and awaits validation (convalidación) by the Standing Committee of Congress (checked on congreso.es on 30 October 2026). If it is repealed, its measures stop applying: the update goes back to what your contract says, within the IRAV limit, and there is no extraordinary extension.

Frequently asked questions

What is the 2026 extraordinary lease extension?

A tenant's right created by the fifth final provision (disposición final quinta) of Royal Decree-law 29/2026: if your main-home lease was in force on 8 October 2026 and its extension ends before 31 December 2028, you can ask to stay in yearly periods, up to two more years, on the same terms and conditions. You must be up to date with the rent and have been every month for the previous eight months.

Can the landlord refuse?

Only in the cases the decree sets: if you have agreed other terms, if you have signed a new contract, or if the landlord has given notice, within the deadlines and conditions of article 9.3 of the Urban Leases Act (LAU), of a real and accredited need to occupy the home for themselves or their family. It also does not apply if you agree to renew or sign a new contract with a rent at least 5% lower.

How do I ask for it?

In writing, before the contract or the extension you are in ends, by a means that records the date (burofax, registered post or email with acknowledgement). Cite the fifth final provision of Royal Decree-law 29/2026, state that you are up to date with the rent and ask for written confirmation. The letter on this page is a model.

I live in a tense rental area (zona tensionada). Which one applies?

First the extraordinary extension of up to three years in the Urban Leases Act itself for tense residential market areas (article 10.3). The decree says its own extension is incompatible with that one and that the Act's applies first.

I already asked for the extension under March's decree (RDL 8/2026). Do I have to ask again?

No. The first transitional provision of Royal Decree-law 29/2026 treats requests made under Royal Decree-law 8/2026 while it was in force as valid, with no new notice. When that extension ends, a new one is requested under this decree's rules.
