Rent rise 2026: how much your rent can go up
If your rent is updated between 8 October 2026 and 31 December 2027, Royal Decree-law 29/2026 sets a cap: nothing if your rent is already above the ceiling of the state reference index and, otherwise, whatever you newly agree or, without a new agreement, at most 2%. Answer four questions and we give you the figure.
Checked on 11 October 2026 against the BOE and congreso.es.
Status of the decree
Royal Decree-law 29/2026 has applied since 8 October 2026 and awaits validation (convalidación) by the Standing Committee of Congress (checked on congreso.es on 30 October 2026). If it is repealed, its measures stop applying: the update goes back to what your contract says, within the IRAV limit, and there is no extraordinary extension.

How the rise is applied
The updated rent can only be demanded from the month after you are notified in writing, with the percentage applied; a note on the previous month's receipt counts (Urban Leases Act, article 18.2). If you are asked for more than allowed, reply in writing with this figure and the decree's reference, pay the rent updated up to the cap and keep a copy.
What the BOE says: «La renta actualizada será exigible al arrendatario a partir del mes siguiente a aquel en que la parte interesada lo notifique a la otra parte por escrito, expresando el porcentaje de alteración aplicado» (Ley 29/1994 ↗).

Frequently asked questions
How much can my rent go up in 2026?
If your annual rent update falls between 8 October 2026 and 31 December 2027, Royal Decree-law 29/2026 (sixth final provision) sets the cap: if your rent is already above the ceiling of the state reference index, nothing; otherwise whatever you newly agree and, without a new agreement, at most 2%. On 900 euros a month, 18 euros.
What if my rent is above the reference index?
No increase can be applied at that update (letter a of the sixth final provision). The index is the Ministry of Housing's state reference system for rents (SERPAVI): it gives a range per home, and what counts is its maximum value.
My contract says it updates with the CPI. Does the 2% cap apply?
Yes. While the decree applies, without a new agreement the rise cannot exceed 2% even if the CPI is higher. The limit in the Urban Leases Act (LAU, article 18) also still applies: the rise can never exceed the change in the IRAV for the latest month published. The lower of the two applies.
How long does the 2% cap last?
Up to the updates that fall on 31 December 2027. The decree awaits validation (convalidación) by the Standing Committee of Congress; if it is repealed, it stops applying that same day and the Act's rule returns: what the contract says, within the IRAV limit.
What do I do if the landlord raises the rent by more than allowed?
A rise is only due from the month after a written notice stating the percentage applied (LAU article 18.2). Reply in writing with this page's figure and the decree's reference, pay the rent updated up to the cap and keep a copy. For questions, the Ministry's free line is 047; your region's consumer and housing offices also help.
